Terms of Use

1. Service
Chillky is an AI-assisted calling, captioning, translation, invite-link, profile, people, recents, visual-context, reminder, and recap app. Features may depend on your device, network, language support, third-party providers, account status, and permissions you choose to grant.
2. Agreement required
You cannot use Chillky unless you agree to these Terms and the Chillky Privacy Policy. If you do not agree, do not sign in or use the service.
3. Not an emergency service
Chillky is not 911, 112, or any emergency, public-safety, medical, crisis, or critical communications service. Do not use Chillky where delay, mistranslation, dropped audio, app failure, network failure, or AI error could cause harm. Use your phone’s emergency dialer or local emergency services instead.
4. Age 16+
Chillky is not for children under 16. You must be at least 16 years old, or older if the law where you live requires a higher age to use online services without parent or guardian authorization, to create an account or use Chillky. If you are 16 or 17, you confirm you have any parent or guardian permission required where you live.
5. Real account and security
Chillky requires a real supported sign-in provider. You may not use a fake identity, another person’s account, an automated account, or an account created to evade safety, legal, or product limits. Keep your device, sign-in provider, and account secure.
6. Your content and permission to process it
Your profile photo, saved people, invite details, call content, shared photos, captions, translations, summaries, prompts, feedback, and other information you provide remain yours. You give Chillky a worldwide, non-exclusive permission to host, transmit, process, transform, display, store, secure, troubleshoot, and improve that content as needed to operate the features you choose, protect the service, and satisfy legal obligations.
7. Audio and AI processing
Chillky does not store call audio recordings. To provide real-time translation, captions, suggestions, reminders, recaps, and similar features, Chillky and AI providers may process live or temporary audio, transcripts, translations, metadata, and AI inputs/outputs. For example, the AI may use conversation context to suggest reminders or useful follow-up while the feature is enabled.
8. Call memory and saved artifacts
When call memory, transcripts, summaries, reminders, or recaps are enabled, Chillky may save transcripts, summaries, translations, reminders, and related AI artifacts to your account. You may turn supported memory/recap features off and use realtime translation/captioning without saving those artifacts, subject to temporary processing needed to operate and secure the service.
9. AI outputs
Captions, translations, recaps, reminders, suggestions, generated text, and other AI outputs may be incomplete, delayed, offensive, outdated, non-unique, or wrong even when they sound confident. You are responsible for checking outputs before relying on, sharing, or acting on them.
10. Professional and high-risk decisions
Do not use Chillky or its outputs as the sole source of truth, as professional advice, or to make legal, medical, financial, employment, education, housing, insurance, immigration, safety-critical, emergency, or other material decisions about yourself or another person.
11. Calls, recording, and consent
Only start, join, record, transcribe, translate, summarize, upload, or share calls, images, or visual context when you have the legal right and required consent from everyone involved. You are responsible for following call-recording, wiretap, privacy, publicity, biometric, and communications laws where you and other participants are located.
12. Sensitive information
Do not submit confidential, privileged, regulated, health, financial, biometric, government-ID, child, trade-secret, or highly sensitive information unless you have the right to do so and accept the risk that providers may process it to deliver the feature.
13. Prohibited use
Do not use Chillky to harass, threaten, defame, impersonate, exploit minors, create sexual abuse, promote hateful abuse, facilitate violence or self-harm, commit fraud or scams, violate privacy or intellectual property rights, track or surveil people without consent, generate malware or spam, bypass safety systems, scrape or programmatically extract content, reverse engineer the service, overload infrastructure, sell or sublicense access, or use Chillky where prohibited by law.
14. AI disclosure and public sharing
Do not misrepresent AI-generated captions, translations, recaps, reminders, or messages as purely human-created when that would deceive someone or affect their rights. If you share Chillky outputs outside the app, you are responsible for context, accuracy checks, required labels, permissions, and legal compliance.
15. Third-party services
Chillky may use providers for authentication, database/storage, real-time calls, hosting, diagnostics, analytics, crash reporting, notifications, and AI features. Provider terms and privacy practices may also apply. Chillky is not responsible for third-party services outside Chillky’s control, app stores, network carriers, device operating systems, or sign-in providers.
16. Feedback and improvements
If you send feedback, bug reports, ratings, support messages, or ideas, Chillky may use them without compensation to debug, secure, develop, and improve the app. Private calls and private content are not intentionally used to train public AI models. Feedback, diagnostics, safety data, and aggregated or de-identified metrics may be used to improve Chillky and protect users.
17. Moderation, preservation, and enforcement
We may review, remove, restrict, preserve, or disclose content and limit, suspend, or remove access if we believe you violated these Terms, created risk, broke the law, infringed rights, abused the service, or if needed to protect users, providers, Chillky, Oberil LLC, or the public. We may preserve records when required for security, fraud prevention, disputes, compliance, or legal requests.
18. Service changes
Features may change, pause, or stop for security, reliability, legal, provider, business, or product reasons. We may set usage limits, block abusive traffic, remove unsafe functionality, or require app updates.
19. Intellectual property
Chillky, its design, software, marks, and product assets belong to Oberil LLC or its licensors. You may not copy, modify, distribute, sell, lease, decompile, or build competing services from Chillky except where the law allows.
20. Copyright and complaints
If you believe content in Chillky infringes your rights or violates these Terms, contact support@oberil.com or contact@oberil.com with enough detail for review.
21. Export controls and restricted use
You must follow applicable trade, sanctions, export-control, and anti-corruption laws. Do not use Chillky where doing so is prohibited, with restricted parties, or for prohibited end uses.
22. Warranty disclaimer
To the maximum extent allowed by law, Chillky is provided “as is” and “as available.” We do not promise uninterrupted service, error-free calls, perfect audio, perfect captions, perfect translations, perfect AI output, permanent storage, or that Chillky will meet every need.
23. Limitation of liability
To the maximum extent allowed by law, Chillky and Oberil LLC are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, service interruptions, provider failures, or damages caused by user content, AI output, consent failures, or misuse. To the maximum extent allowed by law, total liability is limited to the greater of the amount you paid Chillky in the 12 months before the claim or 100 USD. Nothing limits liability that cannot legally be limited.
24. Your responsibility for claims
To the extent allowed by law, you are responsible for losses, claims, complaints, damages, and costs arising from your content, your misuse of Chillky, your violation of these Terms, your violation of another person’s rights, or your failure to obtain required consent for calls, recordings, uploads, translations, summaries, or sharing. If you use Chillky for a business or organization, you agree to defend and indemnify Chillky and Oberil LLC from those claims to the extent allowed by law.
25. Ending use and deletion
You can stop using Chillky at any time. Account deletion and data deletion requests can be made through in-app controls when available, support@oberil.com, or the public account deletion page. Active account data is scheduled for deletion or de-identification within 30 days after a verified deletion request, and backups/provider caches may take up to 90 days. Limited fraud, abuse, security, legal, tax/accounting, dispute, consent, and deletion-request records may be retained as needed.
26. Changes and contact
We may update these Terms when Chillky changes, when laws or provider requirements change, or for security, abuse-prevention, or operational reasons. If a change materially affects your rights, we will try to provide reasonable notice where practical. If you do not agree, stop using Chillky. For support, contact support@oberil.com.
